SetPoint Terms of Service

Welcome to SetPoint. By creating an account or using the SetPoint mobile application ("App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. Eligibility

You must be at least 13 years old to use SetPoint.

If you are under 18 years old (“Minor”), you may only use the App with the involvement and consent of a parent or legal guardian. By using the App as a Minor, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

We reserve the right to restrict, suspend, or terminate accounts based on age or for failure to comply with these requirements.

You agree to provide accurate and complete information when creating an account.

2. Minor Accounts and Restrictions

If you are under 18, additional restrictions may apply to your use of the App.

These may include, but are not limited to:

Private account settings by default
Limited ability to message or interact with users who are not approved connections
Restrictions on joining games, groups, or discovery features

We may enforce these restrictions at our discretion to promote user safety.

Parents and guardians are responsible for supervising a Minor’s use of the App and all activity conducted under the Minor’s account.

3. Account Responsibility

You are responsible for:

Maintaining the confidentiality of your account credentials
All activity under your account
Notifying us immediately of any unauthorized access

4. Acceptable Use

You agree that you will not:

Harass, threaten, or harm other users
Engage in abusive, unsafe, or inappropriate behavior
Exploit, harm, or attempt to interact inappropriately with minors
Post or share illegal, offensive, or infringing content
Use the App for unauthorized commercial purposes
Attempt to misuse, disrupt, reverse engineer, or damage the App
Create fake accounts, spam, or abuse platform features

We may remove content or restrict accounts that violate these rules.

5. Real-World Interactions and Assumption of Risk

SetPoint is a platform that enables users to coordinate recreational activities.

SetPoint does not organize, host, supervise, or control any matches, events, or in-person interactions.

By using SetPoint, you acknowledge and agree:

You are solely responsible for your interactions with other users
You meet other users and participate in activities at your own risk
You assume all risks, including but not limited to:
- Physical injury
- Harassment or misconduct
- Disputes with other users

You acknowledge that users may be adults or minors and agree to exercise appropriate judgment and caution.

SetPoint makes no guarantees regarding the safety, identity, or conduct of any user.

6. User Safety and No Verification

SetPoint does not conduct background checks or verify user identities.

We do not guarantee the accuracy of user profiles or the behavior of users.

We do not supervise interactions between users.

You are responsible for exercising caution and good judgment when interacting with others.

7. User-Generated Content

You retain ownership of content you submit.

By posting content, you grant SetPoint a non-exclusive, worldwide, royalty-free license to use it to operate and improve the App.

You represent that you have the rights to all content you upload.

8. Location Services

SetPoint may use location data (with your permission) to:

Identify nearby courts
Enable match coordination
Improve discovery features

Sharing location information may expose your presence to other users. You acknowledge and accept this risk.

You may disable location access, but some features may not function properly.

9. Service Availability

The App is provided “as is” and “as available.”

We may modify, suspend, or discontinue any part of the App at any time.

10. Limitation of Liability

To the fullest extent permitted by law, SetPoint shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including:

Personal injury
Loss of data
Loss of profits
Damages arising from interactions with other users

SetPoint’s total liability shall not exceed the greater of:

$100 USD
The amount you paid to SetPoint in the past 12 months

11. Indemnification

You agree to defend, indemnify, and hold harmless SetPoint and its affiliates from any claims, damages, or expenses arising from:

Your use of the App
Your interactions with other users
Your violation of these Terms
Your violation of any law or third-party rights

12. Termination

We may suspend or terminate your account at any time, for any reason, at our sole discretion, without notice.

You may delete your account at any time.

13. SMS Communications (SetPoint SMS program)

This section describes the SetPoint SMS program for automated text messages sent by or on behalf of SetPoint to mobile numbers in supported regions.

How you opt in

To receive SMS from this program, you must:

Create a SetPoint account and check an unchecked-by-default box agreeing to our Terms of Service and Privacy Policy before your account is created; and
When you add a mobile phone number in the App (during onboarding or under Profile → Add phone), check a separate unchecked-by-default box consenting to the SetPoint SMS program. You must complete that consent before we save your number or send program messages to it.

What we may send

After you opt in, you agree to receive automated, recurring text messages about:

Account verification and security codes
Match invitations and RSVP prompts that you initiate or that another member initiates for a specific match
Time-sensitive match logistics for matches you are involved in, such as cancellations or time or location updates.
Important service-related notices tied to your use of the App

Message and data rates may apply. Message frequency varies based on your activity and the actions of other members you interact with.

Opt-out and help

To stop receiving SMS from this program, reply STOP at any time. You may receive a one-time confirmation that your opt-out was received.

Invitations you send to others

If you use a feature to invite someone by SMS, you must confirm in the App that you have permission to contact that person about the specific match or activity. SetPoint may send a one-time transactional message to that number identifying you, the match, and an RSVP link on api.setpoint.fit. That recipient may reply STOP to opt out of further SMS from SetPoint where supported.

Wireless carriers are not liable for delayed or undelivered messages.

14. Changes to Terms

We may update these Terms periodically. Continued use of the App constitutes acceptance of the updated Terms.

15. Governing Law

These Terms are governed by the laws of the State of Delaware.
